Midnight Market: Terms & Conditions By purchasing a ticket, possessing a ticket, or entering the Event, you (the "Participant," "Bearer," or "Holder") agree to the following terms and conditions set forth by MMFB PRODUCTIONS LLC ("Festival Producer"): 1. ALL SALES ARE FINAL (REFUND POLICY) Midnight Market is a Rain or Shine event. The 7-Day Rule: Refund requests will only be considered if submitted in writing to the Festival Producer at least seven (7) days prior to the scheduled event date. Final Sale: After the 7-day window, no refunds, exchanges, or credits will be issued for any reason, including travel delays, social conflicts, or changes to the vendor lineup. Rescheduling: If the event is postponed or rescheduled, your ticket will be valid for the new date. No refunds will be issued for rescheduled events. 2. AGE REQUIREMENT (21+) Midnight Market is strictly a 21+ event. You must present a valid, government-issued photo ID at the entrance. If you are underage, or fail to present a valid ID, you will be denied entry without a refund. 3. THE “BEARER” & GUEST CLAUSE If you are purchasing tickets for a group, you are responsible for your guests. Binding Agreement: These terms apply to the original purchaser and any subsequent holder of the ticket. The purchaser warrants they have the authority to bind all guests to these terms. Indemnification: If you purchase a ticket for a third party and that person brings a legal claim against MMFB Productions, you agree to indemnify, defend, and hold the Festival Producer harmless from any costs, damages, or legal fees resulting from that claim. 4. FOOD, DRINK, & ALLERGY DISCLAIMER Midnight Market is a marketplace of independent creators. Third-Party Vendors: All food and beverages are provided by independent third-party vendors. MMFB Productions does not prepare the food and is not responsible for food handling, nutritional claims, or cross-contamination. Allergies: Participants with food allergies or sensitivities consume items at their own risk. We cannot guarantee an allergen-free environment. 5. WEAPONS-FREE POLICY & SECURITY Midnight Market maintains a strict zero-tolerance weapons policy. Prohibited Items: You are prohibited from carrying weapons of any kind—including firearms (concealed or displayed), knives, or any items deemed dangerous by security—regardless of any local permits. Consent to Search: By entering, you consent to a bag check and/or security screening. MMFB Productions reserves the right to deactivate your ticket and remove you from the premises without a refund if you violate this policy. 6. ANIMAL POLICY To ensure the safety and comfort of all guests in a high-capacity, indoor food-service environment, Midnight Market is a pet-free event. No Pets or ESAs: No pets or Emotional Support Animals (ESAs) are permitted inside the venue. Service Animals: In accordance with the ADA, task-trained Service Animals are the only animals permitted. Service animals must be under the handler's control (tethered or leashed) at all times. Guests who arrive with non-service animals will be denied entry without a refund. 7. PHOTO & VIDEO RELEASE Smile! By entering Midnight Market, you grant MMFB Productions the irrevocable right to use your image, likeness, and voice in any media (including social media, marketing, and video production) worldwide, forever, without compensation or further approval. 8. WAIVER & LIMITATION OF LIABILITY You attend Midnight Market at your own risk. The Waiver: You hereby release and discharge MMFB Productions, the Venue, sponsors, and staff from any and all claims for death, personal injury, disability, theft, or property damage arising from your presence at the Event. Health Risk: You voluntarily assume all risks related to exposure to COVID-19 or other communicable diseases. Max Liability: To the maximum extent permitted by law, MMFB Productions' total liability to you is limited to the face value of your ticket. 9. FORCE MAJEURE If "Acts of God" (extreme weather, riots, pandemics, or government orders) make it impossible to produce the event, MMFB Productions may, at its sole discretion, reschedule the event or offer a "make-good" credit. Under these circumstances, all sales remain final. 10. RIGHT TO REMOVE We reserve the right to refuse entry or remove any guest—without a refund—for illegal activity, excessive intoxication, or behavior that threatens the safety or enjoyment of other guests.
